Ai Tel is committed to providing high-quality, high-speed Internet
access. Our goal extends to protect our customers, the Internet Community
and our network from illegal or irresponsible use or activities. These
Terms and Conditions are to ensure the efficient means of operating
the Internet services to fully benefit all of Ai Tel's users.
The account holder agrees that any violation of the Terms and Conditions
will result in termination of service with or without prior notice
and at the sole discretion of Ai Tel Pty Ltd.

- Account Monitoring
Ai Tel will not monitor Internet use, in terms of mail sent
or received, specific web sites visited, newsgroup or chat room
postings, downloads or uploads, or any other infringement of privacy,
unless we have reason to believe a user is committing illegal
acts or otherwise violating published rules. However, Ai Tel
reserves the right to monitor account activity if it adversely
impacts Ai Tel services or customers. Ai Tel reserves
the right to remove messages, suspend service, or terminate service
without prior notice for any of the following listed actions,
among others. Judgment is reserved for Ai Tel Pty Ltd in
its sole discretion. Account holders are reminded that this agreement
is a contractual limitation and Ai Tel Pty Ltd need not
prove that certain conduct is illegal to take action to limit
such conduct.
Account Responsibility
At the time of account registration, you will be required to provide
your personal name and address information. You agree to provide
the correct information about yourself on the registration form.
It is not apart of Ai Tel Pty Ltd's policy to disclose this
information except in certain, exceptional circumstances. The primary
account holder must agree that Ai Tel Pty Ltd may, in its
reasonable good faith discretion and without notice or subpoena,
provide account information to the courts, law enforcement agencies
or others involved in the prosecuting claims or investigations for
conduct alleged to be criminal or that would lead to civil liability.
The primary account holder agrees to be responsible for all account
activity, whether or not the primary account holder is involved
with or aware of the sub-account use. A violation of this agreement
by the Primary Account Holder or any sub-account holder could lead
to the termination of service by Ai Tel Pty Ltd.
Remember that the primary account holder is responsible for all
charges incurred by you or anyone you allow to use your account
(including additional email accounts), including your children,
family members or friends. Unless your account or credit card information
is obtained un-lawfully or fraudulently by someone other than those
authorized to use your account, the primary account holder will
be responsible for all usage and purchases under your account.
The primary account holder and any member of the primary account
holder's household are the only individuals authorized to access
Ai Tel services unless otherwise notified by Ai Tel
Pty Ltd. At no time may there be the simultaneous use of the same
account login/username and password combination without notification
to and notification from Ai Tel Pty Ltd. Ai Tel Pty
Ltd reserves the right to prevent any simultaneous use, or
to automatically create a new, separate account and charge the primary
account holder for set-up and monthly account fees. Simultaneous
logins of an account constitutes account sharing and can result
in termination of the account if the matter is unresolved.
Revealing your account to others or allowing use of your account
by others (other than the authorized users in your household) is
prohibited. Each primary account holder is responsible for ensuring
the privacy of any passwords. Do not give your password to anyone,
including other users. You agree not to give your password to other
users and you agree to indemnify and hold Ai Tel Pty Ltd harmless
for any improper or illegal use of your account. This includes illegal
or improper use by someone to whom you have given permission to
use your account. You could lose your account if you let someone
use it inappropriately.
Dial-Up Accounts
Ai Tel dialup accounts are not intended to be used as continuous
dedicated connections. Unlimited access means that you will not
be charged per-minute access charges while actively using the Internet.
Your computer may remain connected to the Internet as long as the
computer is being operated by a human operator. Using electronic,
software, or mechanical methods to avoid disconnection due to inactivity
or to establish non-monitored connections are prohibited and may
result in the termination of the account. Ai Tel Pty Ltd reserves
the right to disconnect those who are connected but not active.
- Customers understand and agree that temporary interruptions
may occur as normal and reasonable events in the provision of
the service. Ai Tel does not make any warranty as to the
results obtained from the use of the service or warrant that the
service will be uninterrupted or error free.
- Ai Tel is not liable for any delay in correcting any fault
in any service, failure or any incorrect operation of any service
or any other default in performance (including but not limited
to war, accident, act of God, malfunction, destruction, embargo
or default provided by any other third party or other service
provider).
- Any unused megabytes within the download limit available in
a month are not rolled over into the following month.
- Dial-up service accounts are entitled to 5 mailboxes to be
used only with that dial-up service.
- Each paying plan account is entitled to a free personal webpage
(up to 10MB webspace hosted) of the form www.frontierisp.net.au/~username.
Where you elect to use the Web Hosting component by hosting a
site such as www.yourcompany.com.au, Ai Tel will supply
this on the Web Hosting Terms and Conditions notified in the registration
process.
- Only one login at a time is permitted on the dial-up service
unless otherwise specified. Ai Tel Pty Ltd reserves the
right to prevent any multiple concurrent logins or simultaneous
use, or to automatically create a new, separate account and charge
the primary account holder for set-up and monthly account fees.
Simultaneous logins of an account constitutes account sharing
and can result in termination of the account if the matter is
unresolved.
- All satellite plans and packages have no contracts unless arranged
on a per customer basis.
- A session limit may apply. Customers whose dial-up service
is continuously connected for longer than the allocated session
hours may be disconnected.
- Normal telecommunications charges apply.
- You cannot access this package using an ISDN connection.
Please note that for those who are renting or living in a body
corporate building, you will need written approval from your landlord
or body corporate to proceed. You should also check with your local
council to see if you need a Development Application to install
a satellite antenna.

- Free Help

- Please be aware that Ai Tel Pty Ltd provides a limited
Free Help service to Everyday Clients for the signed up primary
account holder only.

- That is Ai Tel Pty Ltd will provide free help to set
up one new client's system and provide ongoing support as required
on a limited basis to the primary account holder only. Where
the primary account holder authorizes any member of their premises
to use their account then only one person can be nominated to
access Free Help to set up the system. The nominated person is
responsible for answering all enquiries relating to technical
aspects and changing the settings in software to accommodate proper
connection with Ai Tel.

- All other provisions of help for setting up systems, including
extra technical support such as repairs and/or testing of hardware
and/or software or visiting client's premises and setting up other
equipment should be performed by the primary account holder's
computer supplier. Ai Tel Pty Ltd does not guarantee
that all computers will connect successfully to the Ai Tel
dial in service and that the ultimate responsibility of the primary
account holder's equipment is the client themselves. Therefore
any repairs, alterations and/or additions required to make the
equipment functional are the responsibility of the primary account
holder.

- Parental Supervision
All Ai Tel primary account holders must be 18 or older.
Children may have a separate user name, password, and email
address, but they need not provide personal information to Ai Tel
or anyone else. The primary account holder is solely responsible
for the monitoring or filtering of content that is available
to their children or other sub-account users. Ai Tel encourages
parents to get involved with their children's on-line usage
and to be aware of the activities in which they are participating.
Safeguarding the personal information of children is extremely
important. Children should always ask parental permission before
sending any personal information to us, or anywhere else on
the Internet. Parents are encouraged to spend time online with
their children to become familiar with the types of content
available through Ai Tel and over the Internet in general.
Parents should regularly oversee their children's use of email
and other online facilities. Finally, you should be aware that
if your child voluntarily discloses his/her name, email address,
etc. on various forums, or chat areas, such disclosure may result
in unsolicited messages from other parties. Accordingly, you
should discourage your child from doing so. Again, if you have

Personal Web Space
Please be aware that Ai Tel Pty Ltd has a duty
of care to Internet users and is bound by the governing Laws in
Australia applicable regarding web site content. With
this in mind we suggest that any links from your site do not go
to sites that may cause offence and that you do not store pages,
or images, for public viewing that could cause offence and violate
these Ai Tel Terms and Conditions.

- PROHIBITED USES AND ACTIONS
As with any community of individuals, certain rules are required
to facilitate discourse and encourage use by all.
Illegal or Objectionable Behaviour
It would be impractical to catalogue all possible behaviours that
are illegal or otherwise objectionable, but all behaviours that
could lead to civil or criminal culpability outside Ai Tel
services are also prohibited by Ai Tel.
Specifically, the following are of great concern and may lead to
immediate suspension:
- Threatening to harm persons, groups of people or property.
- Defamatory comments or transmitting material that is unlawful,
libellous or slanderous, invasive of another's privacy, abusive
or harassing, harmful, vulgar, or obscene.
- Transmission of confidential information about persons or companies
without authorization.
- Posting messages to bulletin boards or newsgroups that are off-topic,
or posting more than ten messages to a site in two hours, or posting
to more than five newsgroups simultaneously.
- Transmission without permission or authorization of any copyrighted
materials or files or in any way infringing on the copyrights of
others.
- Providing false information on the registration form for Ai Tel
, or impersonating someone else.
- "Spam" is the common term for a large quantity of unsolicited
emails. Spamming is an undesirable activity in the Internet community.
"Spamming" from or through Ai Tel services is strictly prohibited.
Any violation of the policy regarding the sending of unsolicited
email will result in the immediate termination of Ai Tel services
without notice or refund, and a system "clean-up" charge per email
sent.
- The sending of "Bulk" emails, even when solicited, from the Ai Tel
system. We define "Bulk" email as sending of 50 or more similar
messages during a single login session, regardless of session time
and regardless of recipient, or sending ten or more similar email
messages to the same Internet address.
- "Pyramid", "Chain letters" and "Get Rich Quick" activities are
annoying and often illegal, and are prohibited.
- Sending any computer virus through or to Ai Tel.
Inappropriate Language
Rude and vulgar language is usually not appropriate for civilized
communication. Ai Tel requires that you do NOT use such language
anywhere on the Internet whilst connected with Ai Tel and
in particular do not use it in newsgroups or bulletin boards.
Objectionable Material
The word "content" as it applies to the Internet refers to the text,
software, communications, images, sounds and other information provided
online. The Internet is a reflection of society worldwide. All types
of content are available, including that which may offend you.
Ai Tel Pty Ltd is a service provider that makes the Internet
accessible, and that includes access to all available content. Any
search software will, on occasion, return objectionable content
even when the search terms give no hint of a connection to that
content. Each account user agrees to carefully search and use the
Internet, and consequently takes full responsibility for what they
may find. Ai Tel Pty Ltd assumes no responsibility or liability
for content available online, whether provided on the Ai Tel
website or that is available through the online connection provided
by Ai Tel Pty Ltd.
Ai Tel Pty Ltd has the right to remove or prevent
access to content that does not meet the terms of this agreement
or its subjective standards. However, each account user agrees that
Ai Tel Pty Ltd is not responsible or liable for any failure
or delay in removing or blocking such material.

on the accuracy of any of the information and data contained on
this site or other sites to which this site is linked
